Copyright policy

Authors are required to ensure that they have obtained all the necessary rights/permissions for any third-party materials that they want to use in their publication with Benjamins.
Those rights should cover perpetual world-wide distribution in print and electronic format. For instance, if you can only get permission to include an image in your article for five years, that is not acceptable to us, as we cannot remove the image (or your entire article) from the journal issue or book volume after five years.

If you want or need to publish your contribution Open Access, you need to make sure that any permissions for third-party materials will allow them to be included in an Open Access publication under the license that will be applied by Benjamins.

Similarly, if you want to include something from an Open Access publication elsewhere, you need to make sure that the license under which it is made Open Access allows this.

• If the third-party material is Open Access under a 'NoDerivatives' (ND) license you cannot make any alterations to the material, unless you have received permission from the original publisher to do this.
• If the third-party material is Open Access under a 'NonCommercial' (NC) license, you will need to get permission from the original publisher, as Benjamins is a commercial publisher and we will charge a subscription fee if your article with us is not Open Access, and for the print edition in any case.
• If the material is Open Access under a 'ShareAlike' (SA) license, you need permission from the original publisher unless your Benjamins publication uses the exact same license (or if an image you re-use, provides in the Benjamins publication a link to where it can be found and used under that SA license).
• If the third-party material is in the Public Domain, you need to check in which countries this applies, as not all materials may be in the Public Domain world-wide. If the material is under a "CC 0" license, it is certainly in the Public Domain world-wide.

In addition the copyright holder's permission, if possible you should also obtain the permission from the original author for the reuse of their work.

If you generated an image with AI to use instead of a copyrighted image, please be aware that this may not actually work in that manner. If the image is created to imitate or look like the original source, it still could be considered infringement of the copyright of the original, so it would be safer to get permission to use the original, as detailed above. Also, we would need to know if the image was generated with AI, because that might impact on our rights in that image for future copyright requests.

John Benjamins' licensing policy promotes the facilitation of the exchange of scientific information in accordance with STM permission guidelines. We pursue a fair treatment of requests according to common practice.

John Benjamins Publishing Co. grants permission without fees for the reproduction in another work or copying of a short prose extract (less than 400 words), a single figure or a single table, in which it holds the rights. Fees may apply for any other use or materials. In either case, prior permission should be requested. It is up to the publisher's discretion to grant permission in each individual case and to determine whether any fees are required.

To request permission, send an email to Rights & Permissions, rightsbenjamins.nl . Please provide as much detail as possible about the material you want to reuse, and the publication that it will be reused in.

All permissions are for one-time use only and on condition that a full acknowledgement of and reference to the publication and copyright-owner will be given. The acknowledgement line should look like this:

with a full reference included in the reference section of your publication.

It is usually the original publisher of a work who holds the copyright. In particular cases, i.e. anthologies, covers, illustrations, diagrams or graphics, we may not be the copyright holder of the extract or work you wish to use. Please check the (preliminary pages in our) publications for specific mention of the copyright holder before contacting us. Any requests concerning third party materials included within our publications should be addressed to the copyright holder of those materials; we are unable to help you with those.

In addition the copyright holder's permission, if possible you should also obtain the permission of the original author for the reuse of their work.

John Benjamins Publishing Company can issue licenses to educational institutions to enable them to make parts of our publications available via a secure local net/learning management systems, to students and staff for a specific course and time period. The same fees apply for digitization as for reproductions and photocopying and is calculated on a 'per student' basis. In certain circumstances a flat fee may apply.

Permission to reproduce our material may be withheld when it concerns a very substantial portion of the book; for instance if the entire book is relevant for the course in question. In such cases the book can be proscribed for classroom use and there is no justification to grant photocopying rights.

For licensing of materials we work with Copyright Clearance Center; institutions/organizations wishing to license materials for internal (classroom) use, if the required licensing can be arranged through CCC.

John Benjamins Publishing Company grants world wide translation licenses (in full or part) in any language. In certain cases rights might be withheld. If you have an interest in a specific title please contact our Rights & Permissions department (rightsbenjamins.nl) to check if rights are available for that language.

Academics who want to have a work translated or translators who want do a translation are advised to contact a local publisher first, and then have that publisher contact us to arrange the translation rights.
